Federal: dyed diesel skips the federal diesel tax except 0.1c. IRS news release IR-2026-122 (14 October 2026) waives federal penalties for highway use of dyed diesel from 1 October 2026 to 31 December 2026; state rules below still apply.

Florida fuel tax on dyed diesel

Dyed diesel used for the purposes Florida lists is exempt from the state and county diesel taxes. Licensed local governments and mass transit providers pay reduced rates (19.9c and 5c) when they use it on the road.

Sales tax

6% use tax on dyed diesel used in a trade or business. Exempt: fuel used only on a farm, home heating and cooking, commercial fishing and aquaculture (with a certificate).

Who may use it

Farming, local government, school and public buses, commercial and noncommercial boats, off-road and stationary equipment. Never in a highway vehicle unless the statute allows it.

Penalty for highway use

Civil: the greater of $1,000 or $10 a gallon, multiplied for repeat violations. $2,500 a month for a pump without the dyed-fuel notice.

Roadside testing

Revenue inspectors may sample fuel and stop vehicles transporting fuel without notice.

Buying it

No permit for end users. Retail pumps may sell it with the federal notice. Businesses self-report the 6% use tax unless the seller collects it.

What shapes the diesel price in Florida

Florida has no major refineries. Every gallon arrives by tanker or pipeline from Gulf Coast refineries. The Strategic Intermodal System highways, I-10, I-75 and I-95, carry some of the highest truck-stop fuel volumes in the Southeast, and tourism and RV traffic add year-round demand above the per-capita norm. Tampa and Jacksonville are the state's fuel distribution hubs. EIA reads Florida through the Lower Atlantic district rather than as its own diesel series.
