Washington fuel tax on dyed diesel

Dyed diesel carries no Washington fuel tax; tax is due if it is used on a highway. Like all petroleum, it carries the hazardous substance tax (about 3.5c a gallon) charged on first possession.

Sales tax

Retail sales tax applies, except diesel sold to a farm fuel user for farming with an exemption certificate.

Who may use it

Farm equipment with a Q decal within 25 miles of its registered address, construction equipment, generators and welders, boats.

Penalty for highway use

The greater of $10 a gallon or $1,000 per tank, applied separately to bulk tanks, multiplied for repeat offences within 5 years.

Roadside testing

Yes: the Department of Licensing, State Patrol and commercial vehicle officers may sample fuel for dye. Washington says the federal relief does not change state law.
